Judge Rules That Pro-Gay Marriage Group Can Canvass Outside Of Target Stores

SAN DIEGO — A judge ruled Thursday that a San Diego pro-gay marriage group can continue canvassing outside of Target stores in California, but the group’s volunteers must stay 30 feet away from store entrances and canvass at just one entrance at a time. The Minnesota-based retail giant had sought an injunction barring the activists from every outlet in the state, alleging they harass customers by cornering them near store entrances to discuss gay marriage, solicit donations and collect signatures on petitions. Rights advocates have warned that the legal battle between Target and Canvass For A Cause could further damage the retailer’s already strained relations with the gay and lesbian community. Canvass For A Cause director Tres Watson called Thursday’s ruling a win for not only his organization, but also for free speech. “I think this is a victory for every American that cherishes our fundamental values,” he said. Superior Court Judge Jeffrey Barton said some Target stores may fall under California’s law that considers shopping centers to be public forums. Also, canvassing over the last year occurred mainly without incident and Target failed to demonstrate that customers were being harassed, he said. “Target has not met its burden to show that its blanket policy to ban all solicitors at all stores in California is proper,” he wrote. The corporation has said at least eight Target stores in the San Diego area have received more than a dozen complaints daily since canvassers started working the locations in October 2010. The activists have refused to leave when asked politely and shown the company’s policy prohibiting “expressive activity” on its property, Target said. During a court hearing last month in San Diego, Barton asked Target’s Los Angeles-based attorney David McDowell why the company didn’t present testimony from customers who the company said had complained. McDowell said the testimony could have been obtained, but he didn’t think it was necessary since the complaints weren’t the central issue. The case was about Target’s right to enforce its rules on its land, he said. “The question is Target’s property right and its right to exclude,” McDowell said. Target Corp. said in a statement Thursday that the legal action was “to provide a distraction-free shopping environment for our guests.” “Target’s long-standing policy is that we do not permit solicitation or petitioning at our stores regardless of the cause or issue being represented,” the company said. Barton warned the San Diego group to be respectful and to not block the flow of traffic. The restriction to canvass at just one entrance at a time was to ensure that customer access wasn’t impeded, he said in the ruling. Watson said the constraints wouldn’t affect the group’s work because volunteers don’t follow people into stores or block store entrances. Target was seen as an ally of the gay and lesbian community before it made a $150,000 donation to a business group backing Minnesota Republican candidate Tom Emmer, an opponent of gay marriage who lost last year’s governor’s race to Democrat Mark Dayton. The company later apologized for the hurt feelings and tried to repair its image by creating a committee to help scrutinize its decisions on donations. Target also negotiated a deal with Lady Gaga to sell a special edition of her upcoming album in a partnership Gaga said was tied to their “reform” – supporting the gay community and making up for past mistakes. The singer cancelled the deal a few weeks ago.

WASHINGTON — A deadline looming, the Congress’ top Democrat accused Republicans on Friday of risking a government shutdown because they want to make it harder “for women to get cancer screenings.” Senate Majority Leader Harry Reid unleashed his attack as his main antagonist in long-running negotiations, Speaker John Boehner, said spending cuts — not social issues– were blocking agreement to prevent a shutdown at midnight. “Most of the policy issues have been dealt with and the big fight is about spending,” Boehner said Friday afternoon. The maneuvering unfolded as President Barack Obama canceled a trip to Indianapolis and spoke in separate phone calls with Reid and Boehner. “Discussions between the leaders and the White House aimed at reaching a budget agreement are continuing,” White House press secretary Jay Carney said in a written statement. “I assure you, these are not unresolvable issues,” added Senate Republican Leader Mitch McConnell of Kentucky. Obama, Reid and Boehner met at the White House on Thursday evening for the third time in two days, and their aides struggled without success to reach agreement in middle-of-the-night talks in the Capitol. For a nation eager to trim to federal spending but also weary of Washington bickering, the spending showdown had real implications. A closure would mean the furloughs of hundreds of thousands of workers and the services they provide, from processing many tax refunds to approving business loans. US DoJ approves Google’s acquisition of ITA, but not without stipulations

The United States government may be dissolved tomorrow, but it’s certainly taking care of one final piece of business before going into shutdown: this . If you’ll recall, Google announced its intentions to acquire ITA for $700 million in July of last year, and as we cruise into the start of America’s summer travel season, all signals are go. Today, the US Department of Justice approved Google’s request to move forward with the buy, but rather than having the entire travel search market under its wing, El Goog’s going to have to make a smattering of concessions in order to get the right signatures. For starters, the search monolith will allow ITA’s existing client contracts to extend into 2016, and it’ll let both current and new customers license ITA’s QPX software on “fair, reasonable and non-discriminatory terms.” No one’s saying when the integration will be complete (or start, for that matter), but we’re desperately anxious to see just how Kayak and Bing Travel react after this launches in earnest. CBS Goes to Statue of Liberty to Hype Shutdown’s ‘Ripple Effect’

On Friday's Early Show, CBS's Betty Nguyen used the Statue of Liberty as a live backdrop to play up how ” visitors would miss out on the Smithsonian and its 19 museums … even the National Zoo ” if the federal budget impasse leads to a government shutdown. Nguyen also highlighted that the “Cherry Blossom Festival…[is] set to wrap up this weekend, but the parade may not march on if the government shuts down .” Fill-in anchor Rebecca Jarvis introduced the correspondent's report, which ran 10 minutes into the 7 am Eastern hour, by outlining that the cost of a shutdown might be $8 billion a week “because there are so many government employees who won't be working, agencies that will shut down, and there are costs to restarting them, including our country's national parks, which is where we find…Betty Nguyen at Liberty State Park, in the shadow of the Statue of Liberty, with more on the expected impact at those locations.” Nguyen began with the shutdown's possible effect on the visitors to the monument in New York Harbor and expanded out to what might be the negative effects at all of the national parks, along with the government-funded sights in Washington, DC: NGUYEN: The Statue of Liberty is just one national monument that would close if the government does shut down. Now, let me put this in perspective for you: 10,000 people visit her every single day- that is 5 million people each year- and she is just one of many of the different national parks in the system. There are 394 national parks across the country. In April, some 800,000 visitors will spend $32 million a day at these parks. Now, that's money that would be lost from local economies across the country. Even more bad news: nearly 20,000 park employees would be sent home . Now, out west, one major attraction that would be affected is Yellowstone National Park. It's a popular destination for campers who might have to pitch their tents elsewhere, if the government shuts down . Another big attraction: Washington, DC- visitors would miss out on the Smithsonian and its 19 museums, galleries, even the National Zoo. Also in DC, the Cherry Blossom Festival- that's set to wrap up this weekend, but the parade may not march on if the government shuts down. Now, along with government employees that would be furloughed, some 15,000 people, who work around these national monuments and parks- in the hotels, the restaurants, the gift shops- they would be deeply affected if the government does shut down . After the end of the report, Jarvis added, ” There's a ripple effect on all of these things .” Anchor Chris Wragge replied, ” Yeah, without a doubt , and we wait and see what happens.” Nguyen's report lines up nicely with the mainstream media's playbook from the 1995 shutdown.
