Apparently, our General staff is shot through with Little Caesars who fancy themselves the masters of the universe or something. Last year it was McChrystal and insubordination. This year it is Caldwell, a three-star in charge of training Afghan troops who stands accused of using psy-ops against visiting American Senators and Congressmen so they would give the war effort more troops . He needs to be relieved of command immediately and his ass needs to be on a plane bound for Washington for a public humiliation and firing. The U.S. Army illegally ordered a team of soldiers specializing in “psychological operations” to manipulate visiting American senators into providing more troops and funding for the war, Rolling Stone has learned – and when an officer tried to stop the operation, he was railroaded by military investigators. The orders came from the command of Lt. Gen. William Caldwell, a three-star general in charge of training Afghan troops – the linchpin of U.S. strategy in the war. Over a four-month period last year, a military cell devoted to what is known as “information operations” at Camp Eggers in Kabul was repeatedly pressured to target visiting senators and other VIPs who met with Caldwell. When the unit resisted the order, arguing that it violated U.S. laws prohibiting the use of propaganda against American citizens, it was subjected to a campaign of retaliation. “My job in psy-ops is to play with people’s heads, to get the enemy to behave the way we want them to behave,” says Lt. Colonel Michael Holmes, the leader of the IO unit, who received an official reprimand after bucking orders. “I’m prohibited from doing that to our own people. When you ask me to try to use these skills on senators and congressman, you’re crossing a line.” The list of targeted visitors was long, according to interviews with members of the IO team and internal documents obtained by Rolling Stone. Those singled out in the campaign included senators John McCain, Joe Lieberman, Jack Reed, Al Franken and Carl Levin; Rep. Steve Israel of the House Appropriations Committee; Adm. Mike Mullen of the Joint Chiefs of Staff; the Czech ambassador to Afghanistan; the German interior minister, and a host of influential think-tank analysts. The incident offers an indication of just how desperate the U.S. command in Afghanistan is to spin American civilian leaders into supporting an increasingly unpopular war. According to the Defense Department’s own definition, psy-ops – the use of propaganda and psychological tactics to influence emotions and behaviors – are supposed to be used exclusively on “hostile foreign groups.” Federal law forbids the military from practicing psy-ops on Americans, and each defense authorization bill comes with a “propaganda rider” that also prohibits such manipulation. “Everyone in the psy-ops, intel, and IO community knows you’re not supposed to target Americans,” says a veteran member of another psy-ops team who has run operations in Iraq and Afghanistan. “It’s what you learn on day one.” Of course, we all realize that it goes on. Images are manipulated and messages are massaged. Before they appear before Congress, Generals confer with image consultants to lead the star-struck officials before them where they want them to go. But this is a whole new level of evil. Not only did Caldwell intentionally violate U.S. laws against propagandizing American legislators, he punished the guy who stood up and said it was wrong. If that isn’t intent and malice of forthought, I don’t know what is. Congressional delegations – known in military jargon as CODELs – are no strangers to spin. U.S. lawmakers routinely take trips to the frontlines in Iraq and Afghanistan, where they receive carefully orchestrated briefings and visit local markets before posing for souvenir photos in helmets and flak jackets. Informally, the trips are a way for generals to lobby congressmen and provide first-hand updates on the war. But what Caldwell was looking for was more than the usual background briefings on senators. According to Holmes, the general wanted the IO team to provide a “deeper analysis of pressure points we could use to leverage the delegation for more funds.” The general’s chief of staff also asked Holmes how Caldwell could secretly manipulate the U.S. lawmakers without their knowledge. “How do we get these guys to give us more people?” he demanded. “What do I have to plant inside their heads?” According to experts on intelligence policy, asking a psy-ops team to direct its expertise against visiting dignitaries would be like the president asking the CIA to put together background dossiers on congressional opponents. Holmes was even expected to sit in on Caldwell’s meetings with the senators and take notes, without divulging his background. “Putting your propaganda people in a room with senators doesn’t look good,” says John Pike, a leading military analyst. “It doesn’t pass the smell test. Any decent propaganda operator would tell you that.” At a minimum, the use of the IO team against U.S. senators was a misue of vital resources designed to combat the enemy; it cost American taxpayers roughly $6 million to deploy Holmes and his team in Afghanistan for a year. But Caldwell seemed more eager to advance his own career than to defeat the Taliban. “We called it Operation Fourth Star,” says Holmes. “Caldwell seemed far more focused on the Americans and the funding stream than he was on the Afghans. We were there to teach and train the Afghans. But for the first four months it was all about the U.S. Later he even started talking about targeting the NATO populations.” At one point, according to Holmes, Caldwell wanted to break up the IO team and give each general on his staff their own personal spokesperson with psy-ops training. Remember the blurbs in the news about unnamed politicians whose records had been improperly accessed? Maybe it wasn’t just one guy at the State Department . Maybe he was the fall guy, but the real culprits were these psy-ops folks accessing records on politicians before visits. My Senator, Claire McCaskill, is a pretty high profile member of the Armed Services Committee and she has made several trips to Afghanistan. Was she one of those against whom these tactics were employed? Caldwell shouldn’t just get to walk away from the mess he created like McChrystal did, though. He needs to face criminal charges, and possibly he needs to face war crimes charges if an intrepid prosecutor can build that case. He needs to hang high and be made an example of. He definitely needs to lose his rank and his bennies. He needs to be made to suffer public humiliation. If he is not, then the civilians have ceded control and we aren’t that far from being ruled by a de facto military junta, and that is not the country I want to live in. I’ve been saying it for -weeks- months over a year …it is time for Obama to channel Truman and fire a whole bunch of these flag rank f***heads and pin stars on the shoulders of men like Lt. Colonel Holmes, Paul Yingling and Bob Bateman. Believe me yet?

The View Brings on Two Congressional Abortion Advocates, No Pro-Lifers

ABC's The View on Thursday neglected one side of the abortion debate by bringing on two staunch supporters of Planned Parenthood in Congress without any other guests arguing the pro-life side. As the two championed giving tax money to the abortion provider, Barbara Walters herself defended the organization, while Whoopi Goldberg assisted in spreading a falsehood about “federal dollars” for abortion (audio clips available here ). The show's co-hosts brought on Representatives Gwen Moore and Jackie Speier, two of the current “pro-choice” heroes in Congress supporting Planned Parenthood funding, near the end of their 11 am Eastern hour program to discuss the controversial issue. After playing clips from two of their recent floor speeches in the House of Representatives (they omitted Moore's infamous “ramen noodles” remark), co-host Elizabeth Hasselbeck echoed her colleague Joy Behar's compliment from earlier in the week : ” We're glad you're both here. Courageous, indeed, what you did to bring your own personal stories….I think it touched many women, including us .” [ Video embedded below the page break ] Hasselbeck then asked Rep. Moore, “Congresswoman Moore, your unplanned pregnancy, did that affect your role in politics now?” Moore answered by firing off many of the liberal talking points on the issue: MOORE: …We had a lot of family support, support from friends, and Marquette University. But as I think back on our lives, you know, I've had inadequate day care, subjected her to sexual predators, we've been food insecure, and she's a great woman now, age 41, but she totally supports Planned Parenthood and their role and goal in helping women manage their lives, and a lot about public policy has- prevents women from self-actualizing . You know, we ended welfare as we knew it so that there is no guarantee of public support for women and children ….No safety net whatsoever, and from the moment you crown, you don't have the protection of those who say that they want to see children being born. I mean, in this budget- repair budget bill, they stripped $747 million out of WIC, literally taking- JOY BEHAR (off-camera): Tell them what WIC is. MOORE: Women, Infants and Children's program. It's a program that provides supplements for nursing women and for babies- cut out the child and maternal health services and stripped all kinds of services for women. Many people have called this budget a war on women. Walters stepped in at this point to provide more pro-Planned Parenthood talking points. When Rep. Speier claimed in her reply that no federal funds go to abortion, Goldberg emphatically asked her to repeat her false claim: WALTERS: Yeah, I want to make very clear, because if you just saw those clips, because Congressman Speier, you also got up and told the most personal story of your own experience, which you had not intended to do, because you are for Planned Parenthood because it's not just abortions. They give so much money to education, to helping women understand what their problems might be . BEHAR: HIV testing, cancer screening – WALTERS: HIV testing, etc. – SPEIER: You know, in fact- WALTERS: So you're standing up was to say, hey, you know, it's not just abortions, but if you need one, let me tell you my story, correct? SPEIER: That's correct. In fact, what we were debating on the floor was defunding $300 million to Planned Parenthood just for the health care, for the breast cancer screening- WALTERS: Not to do abortions- SPEIER: Nothing about abortions. In fact, no federal dollars can go to abortions in the budget – GOLDBERG: Will you repeat that again, please, real loud? SPEIER: No federal dollars can go to abortions . HASSELBECK: Congresswoman, I'd like to ask- I just- BEHAR: Since a long time ago, a long time – SPEIER: For over 30 years . Actually, as I noted on Tuesday, when Behar made the same claim on her HLN program, the National Abortion Federation, which represents abortionists nationwide, acknowledges on their own website that federal law ” requires [Medicaid] coverage of abortion in cases of rape, incest, and life endangerment .” Also, pro-life blogger Jill Stanek reported on Thursday , Planned Parenthood does not provide mammograms at their clinics. They only refer for them. Hasselbeck then tossed a possible compromise on the Planned Parenthood funding at the two Democratic representatives, but they continued their staunch support for the organization and the funding status quo: HASSELBECK: But to be clear, Planned Parenthood is the largest recipient of federal funds- also, the nation's largest provider of abortions . My question is, because I come- GOLDBERG: But they're two separate issues! HASSELBECK: I understand that. If so separate, why not separate them? SPEIER: They are separate- HASSELBECK: Why not have it under a different name, a different entity, and why put it all under one, so there is no confusion, so the taxpayer doesn't then have to feel as though their money could potentially be going to an abortion, where someone else is deciding the value of a life in their mind? Why not separate it? SPEIER: Okay. First of all, family planning- MOORE: It's- the money is not fungible. It's- 90%, literally, 90% of the services that Planned Parenthood provide are diagnosis for cervical cancer, diabetes, and only 10% of their services- WALTERS: But Elizabeth is saying, why not separate- HASSELBECK: My point is separate the entities. UNIDENTIFIED WOMAN (off-camera): It is separated. HASSELBECK: Why hard-line it and not under Planned Parenthood? SPEIER: It's important to know that, first of all, they're audited constantly. They have separate facilities to provide services for abortion from the facilities that provide health care to women. They have separate staff. They have separate equipment. Everything is separated. They don't do the services on the same day. HASSELBECK: But it falls under the Planned Parenthood umbrella, correct? My point is it could be clear to everybody if it was just called something else. Representative Speier made another false claim. While many of Planned Parenthood facilities don't provide abortions, many of them do, in the very same building where they provide birth control and HIV screenings. A notorious example of this is their 78,000 square foot facility that the organization opened in 2010 in Houston, Texas . Co-host Sherri Shepard ended the segment by raising the recent undercover videos released by Live Action. Rep. Speier revealed the extent of her support of Planned Parenthood by her strong negative labels of the videos, while Rep. Moore spouted another common talking point in favor of the organization, that they actually prevent more abortions than perform: SHEPHERD: You know Live Action, when they put out the video- they released a video showing some Planned Parenthood employees advising on- people giving false information, so they can get an abortion . Now, they got- the Planned Parenthood- they got fired, the specific employee. GOLDBERG: In [New] Jersey- SHEPHERD: In Jersey. Could this happen again? SPEIER: Well, it happens all the time. I t's been going on for four years, where they've come into Planned Parenthood trying to do these entrapments . It was one woman. She was fired, out of 11,000 employees at Planned Parenthood. HASSELBECK (off-camera): One of them was caught doing it, right? SPEIER: It was a set-up! MOORE: Planned Parenthood prevents abortions . UNIDENTIFIED WOMAN (off-camera): Right- BEHAR: That's the point- WALTERS: Has this gone through? Is this bill (unintelligible) going to pass? What do you think is going to happen to this amendment? HASSELBECK: It prevents and provides- MOORE: It prevents more abortions than it provides, because women do- BEHAR: It happens to be the law of the land also. Let's not forget Roe v. Wade is part of the law of this country. (crowd applauds and cheers) It's not like they're obtaining it illegally – HASSELBECK: I'm not saying that they are. I guess my point is, I think this argument could be very clear if it were just a different- WALTERS: Let them- MOORE: It prevents abortions and it also prevents unhealthy births. You know, when you become pregnant, you do need support of services. You know, Planned Parenthood's clients, 75% of them are at 150% or below poverty level, and 60% of all women use this as their primary health care system. SPEIER: I agree- HASSELBECK: You know, I think you're both courageous women for coming here- MOORE: Thank you so much- HASSELBECK: And we're glad we can have this kind of discussion- only can we have it here! Christchurch Devastated by Earthquake.  Again.

Aerial footage of the damage in Christchurch, New Zealand (courtesy of RT News) enlarge Just before one o’clock in the afternoon today, one of my partner’s colleagues in Dunedin had been on the telephone speaking with another company employee up in Christchurch, when the phone line suddenly went dead. At that same moment, I was at home, working in my office, startled when George, the neighbour’s cat which had been sleeping on top of a bookshelf behind me, suddenly jumped down and ran around the house frantically. A few moments later, we all understood why. Like the earthquake last September , the house began to shudder hard enough that I could see our deck rocking and the high tension power pylons down the hill swaying, the bricks and mortar of our house groaning loudly in protest. It lasted long enough for me to wonder about trying to grab George and get us both outside when it finally stopped. I turned on the radio, and it didn’t take long before reports started to come in. Christchurch was hit again by a devastating earthquake. Although this time it measured 6.3 on the Richter scale compared to the September quake’s magnitude of 7.1, it was at a shallower depth than the September quake, five kilometres rather than ten, and much closer to New Zealand’s second largest city, a mere ten kilometers south in Lyttelton, rather than the September quake’s epicentre in Darfield, forty kilometres west of Christchurch. This time, rather than at night when most people were in their homes asleep, the quake hit at lunchtime, the streets and office buildings in the city full of people. Our time-share kitty couldn’t settle, refused to go outside, and hid behind the bookshelf. Fifteen minutes later, another 5.5 aftershock rocked the South Island, hard enough for us to feel it yet again all the way south in Dunedin. At twenty to four, another big 4.6 aftershock hit, followed five minutes later by another nearly the same magnitude, all violent enough to be felt nearly the entire length of the South Island. Within two hours, the count of aftershocks was up to ten, most of them quite powerful. It’s now late afternoon here, and aftershocks in the magnitude 4 range continue to shake the entire South Island, ten more in the past four hours and more predicted to come, the latest a magnitude 5.0 at 7:43 pm, again near Lyttelton, which has been declared as ‘unliveable’, most of the town’s buildings destroyed or badly damaged. But the time-share cat finally settled back down and sauntered off home, ruffled but unscathed, making me hope that he knows more than I do. To give you some idea just how powerful this quake was, passengers on board boats in the Tasman Glacier’s Terminal Lake, miles away on the other side of the Southern Alps, were rocked by waves up to three and a half metres tall over thirty minutes as thirty million tonnes of glacial ice calved off into the lake , aftershocks causing huge icebergs to roll. In September, only two people were seriously injured, and one person later died of a heart attack. We all counted ourselves extremely lucky, breathed a sigh of relief and thought the worst was over. Lightning and earthquakes don’t strike twice. We were so very wrong . TVNZ has reported that up to 200 people still remain trapped in damaged buildings all over the city. The Pyne Gould Guinness building , built in the 1960s, has completely collapsed, killing at least one person. The collapsed floors of the building look like pages in a book left face down on its spine. Thirty people trapped in the rubble were rescued, including one woman who managed to climb out onto the roof of the pancaked building, lifted down by fire engine ladder. Many more buildings have either completely collapsed or have been severely damaged. Roofs of department stores and malls have collapsed, the glass shattered out of windows, facades and crumbling with each aftershock. There are reports of casualties in the Cashel Mall, where people had been shopping on their lunch hour. More bodies are being pulled from wrecked cars and the rubble of shops. The church across from Radio NZ, the station itself badly damaged, has now completely collapsed. The Press Building has largely been destroyed. The Provincial Chambers Building, the Forsyth Barr Building are in ruins, the historic church of the Blessed Sacrament on Barbadoes Street half collapsed and the rest of the building riddled with cracks. The city’s iconic Christchurch Cathedral, which had barely survived the September quake, has been destroyed , the interior resembling Canterbury after the Blitz, the beautiful spire toppled and the walls of the church collapsing. The list of buildings either partly or completely destroyed or damaged beyond repair is growing. Communication systems are still struggling, landlines cut, mobile phone transmissions hampered by fallen transmitters and overloaded with worried callers. Telecom had begged people not to use their phones except for emergencies, their systems crashing. The land around Christchurch is largely sandy and flat, and the earthquake has liquefied the ground, creating massive floods and mud boiling up from cracks in the roads. Buildings collapsed onto two buses, killing several of the passengers. The roads have been so badly damaged by liquefaction and surface flooding that doors have been pressed into service as make-shift stretchers and four-wheel drive cars are being used as ambulances to transport the injured. Several bodies of backpackers were carried out of the local youth hostel. 80% of Christchurch was without power after the quake, with engineers reluctant to reconnect electrical lines for fear of gas ruptures. People trapped in the Canterbury Television Building have been rescued after part of the building collapsed, but it’s not known yet if there are any other casualties, rescue efforts hampered when the building caught fire. There’s little water to fight fires, helicopters using monsoon buckets dipped into the river to try to fight the flames. Massive clouds of dust from fallen masonry have coated the city in grit. So far, the death toll stands at 65, with Christchurch’s mayor fearing that number could double by tomorrow. The sun has gone down, rain and temperatures falling, as search and rescue teams carry on looking for survivors trapped in buildings. Google has set up a site for people to locate friends and relatives. Thousands of people are crowding into evacuation centres, with water, food, blankets, tents and beds in short supply. New Zealand’s Prime Minister, John Key, left the capital at three thirty this afternoon, accompanied by Christchurch MPs and a member of the diplomatic protection squad, and flew into Christchurch where he was in time to appear on Channel One’s six o’clock news. Finding it ‘hard to know what to say’, he still managed to come up with a suitable enough sound bite, pronouncing that ‘we may well be witnessing New Zealand’s darkest day.’ Incredulous, I wondered aloud what on earth could he be thinking of, rushing down to Christchurch to give television interviews while the city was still reeling in chaos, emergency workers stretched to the limit trying to rescue the injured and trapped. My partner, with typical succinct Kiwi wit, noted that it is, after all, an election year. I just shook my head in disbelief. Tomorrow morning the death toll will no doubt be higher, information a bit clearer, and Christchurch gearing up, yet again, to deal with the destruction of one of New Zealand’s loveliest cities. But until then, I can only worry, hoping my friends in Christchurch are alive and well, and wait for someone to respond to my texts.

In their usual way, they were all smarmily singing loudly and from the same page. What did they flaunt? They revealed how they plan to undo Roe v. Wade . They made it clear what weapon they plan to use and in what arena, which we, the pro-choice movement, have for too long abandoned. All the weapons they need are there, and we left them there for the right to pick up and use to beat us up. The visible weapons are THE HYDE AMENDMENT. LEGISLATION REMOVING FEDERAL FUNDS. The “hiding in plain sight” weapons are THE “LET WOMEN DIE” PROVISIONS; THE ENFORCEMENT MECHANISMS; LAWSUITS; INJUNCTIONS STOPPING ANY AND ALL FEDERAL FUNDS TO ANY AND ALL STATES, CITIES PROGRAMS OR AGENCIES. What are they hiding in plain sight ? How they plan to use the enforcement mechanisms in these bills and any future bills to destroy women’s reproductive freedom. They will attempt to first eliminate every women’s access to abortion while also beginning their assault on all Americans’ access to birth control. Yes indeedy, birth control is now in the crosshairs!! Certainly, that is what the Pence bill defunding Planned Parenthood is all about . Title X funding disburses money for women’s health in general – pap smears, mammograms. And yes, that includes birth control or family planning, something that is now bizarrely controversial. Basically, health care for millions and millions of women. But they do not plan on stopping there. The theory is throw as many bills against the wall as possible, with a lot of similar and dangerous elements. Then watch which elements they attach to which bill as they try through a variety of legislative maneuvers to paint the Senate into a corner, while the President keeps silent. To these extremists Republicans , his present silence means consent. That is certainly how they will propagandize it. HR #3, NO TAXPAYER FUNDING FOR ABORTION AND HR #358, PROTECT LIFE ACT, aka LET WOMEN DIE ACT Those were two subcommittee hearings in the House. On Tuesday the 9th, the Subcommittee of the Judiciary Committee with Chair Trent Franks convened on HR #3. The hearing for HR #358 was held on Wednesday the 10th in the Health Subcommittee of Energy and Commerce with Joe Pitts, Chair. At each hearing, two anti-choice witnesses were invited but only one pro-choice witness. Sara Rosenbaum of GW University was the pro-choice witness for both hearings. She testified on the impact this legislation would have on the subsequent availability of health insurance with abortion. To be precise: there would be NONE. If passed, HR #3 eliminates private and employer provided insurance for abortion coverage. 87% of all employer plans cover abortion. 90% of all insurance access to abortion coverage would be eliminated. Tens of millions of women and families would lose access to abortion. Who needs the public’s boomerang reaction to overturning Roe, when you can eliminate abortion quietly while people don’t yet notice? HR #3 codifies Hyde One of the many awful provisions in HR #3 is turning the various Hyde restrictions in the numerous appropriations bills into permanent law that will reach far beyond where it gets now. Presently, the Hyde restrictions have to be passed via the appropriations process – from poor women in HHS to military and veteran women to Federal employees and even into Medicare for disabled women. Codification would not only make it permanent but extend its reach – to the tax code in their view of the world. Unfortunately, the Democrats have spent 30 years not fighting the Hyde amendment. 30 years of quiet acquiescence, with often only a one sentence demurral by those of us who oppose Hyde. Silence can mean consent in many minds. Anti-Choice witnesses Richard Doerflinger of the U.S. Conference of Catholic Bishops and Cathy Ruse with the Family Research Council at HR #3 hearing and Helen Alvere of George Mason University and Douglas Johnson with National Right to Life at the HR #358 hearing repeatedly touted the “universal” agreement that Hyde is correct. Even Democrats who purportedly call themselves pro-choice, they asserted, agree with the policy that there should be no federal funds for abortion. Silence can mean consent. In an excruciating display of fakery, the four of them lauded President Obama’s support for, in the President’s own words, the ‘federal tradition” behind Hyde. One of the congressmen, Michael Burgess (R-TX), even said that this bill was doing the President a favor by putting forward a bill ( HR #358) to make doubly sure that there would be no taxpayer money going for abortions !!! Do not underestimate the political value of invoking a Democratic president. It will loom large as the battle progresses. At the Democratic press conferences about the two bills, Democrats boldly stated that in no way would the President sign either bill. Apparently, their strategy was hoping such statements would make the President make it clear how repugnant these bills are. Unfortunately when David Axelrod was asked by Chris Bowers about these bills, rather than a strong statement condemning them, Axelrod acted like he wanted this to just evaporate into the air. To this day, we try to protect ourselves from one assault after another by only dealing with the technicalities, with little success. The right has now found a vein of attack that they can mine over and over. They can use funding issues and the tax code to launch one after another. If this one doesn’t work, they can find another. It is a very rich vein….a veritable Silver City lode of potential attacks. As David Waldman writes, “H.R. 3 hides even bigger dangers than redefinition of rape” . ” Take the rape provisions out, and you’re left with a bill that paves the way for using the tax code to select every American’s health care options for them, direct from Washington. ” So what is hiding in plain sight? The remedies sections of both bills are a veritable cornucopia of ways to control women’s access to all reproductive rights – from abortion to birth control. Ironically, the right’s anathema to lawsuits stops when they can use them to have a veto over everyone else’s rights. Both bills have sections entitled Non-Discrimination and Remedies. Doerflinger and Johnson kept coming back to what they euphemistically call “conscience provisions” in their testimonies. They were very wedded to them. WHY? Because without them, they could not get what they wanted: the most draconian, onerous and sweeping anti-choice legislation in forty years. It’s been coming, in bits and pieces, all over the country. For example, the recent South Dakota bill that effectively made legal the intent to kill abortion providers or bills which redefined rape to the bruised, battered and bloody standard. Their radicalism knows no bounds, but under some level of mainstream outrage these bills have then been dialed back . But most outrageously, they have not dialed back the segment of HR #358. That bill was marked up on Friday the 12th, but they kept the section that effectively lets women die in emergency rooms . A bit of backstory: currently, all hospitals in America that receive Medicare or Medicaid funding are bound by a 1986 law known as EMTALA to provide emergency care to all comers, regardless of their ability to pay or other factors. Hospitals do not have to provide free care to everyone that arrives at their doorstep under EMTALA — but they do have to stabilize them and provide them with emergency care without factoring in their ability to pay for it or not. If a hospital can’t provide the care a patient needs, it is required to transfer that patient to a hospital that can, and the receiving hospital is required to accept that patient. In the case of an anti-abortion hospital with a patient requiring an emergency abortion, ETMALA would require that hospital to perform it or transfer the patient to someone who can. (The nature of how that procedure works exactly is up in the air, with the ACLU calling on the federal government to state clearly that unwillingness to perform an abortion doesn’t qualify as inability under EMTALA. That argument is ongoing, and the government has yet to weigh in.) http://crooksandliars.com/node/44077/edit Pitts’ new bill would free hospitals from any abortion requirement under EMTALA, meaning that medical providers who aren’t willing to terminate pregnancies wouldn’t have to — nor would they have to facilitate a transfer. The hospital could literally do nothing at all, pro-choice critics of Pitts’ bill say. They kept that exemption. As awful as it sounds to refuse to save a woman’s life, it’s still there, as is a similar provision in HR #3. Why? Because it allows any anti-choice zealot to launch one lawsuit after another to claim discrimination. Pay close attention to these wording below that give the anti-choice activists a wide berth to control women’s reproductive health: HEALTH CARE ENTITY – note how vague and broadly defined that is. A disgruntled nurse, or receptionist, hospital bookkeeper, it is so broadly written. There must be thousands of such anti-choice health care “entities”. ACTUAL OR THREATENED – Threatened????? What could the word “threatened” possibly encompass? A policy, a mailer on hospital emergency procedures making reference to EMTALA? A training schedule for interns or residents on abortion procedures and many more? Would there even need to be actual instance of supposedly forcing someone to do a procedure or hand out birth control they disapprove of? No, it may be quite sufficient to apply for a job where abortions are done, announce you are anti-choice and then bring a lawsuit when you don’t get hired. George Bush’s last executive order (which was just rescinded), actually had just such provisions. PRIVATE PARTY RIGHT OF ACTION This is the BIGGIE. The Non Discrimination and Remedies sections in both bills (I use HR #3 below) have enforcement mechanisms ranging from utilizing the HHS to the US Attorney General. Those would require anti-choice presidents to direct the agencies. However, both bills have private party right of action. The National Right to Life Committee, or Focus on the Family or the Live Action folks who have long targeted Planned Parenthood clinics are just waiting to spring into action. They can plant themselves into situations in which they are” threatened” with discrimination because they are anti-choice, let thousands of lawsuits bloom while they shop for the right anti-choice judge(s) ENJOINING ALL FEDERAL FUNDS. Their biggest weapon of all. Draconian. If a judge finds for the plaintiff, the anti-choice fanatic, then that judge can, with only one violation enjoin all federal funds . The injunction would not be limited to health care funds. They could stop education funds or transportation funds or law enforcement funds> To whom? To anybody and everybody, basically. That’s how vague the bill has been written. They could, with the cagiest plaintiffs attorneys work to enjoin all federal funds for the state of New York, the City of New York, the NYPD or all the school districts in NY State over a single lawsuit over a single woman’s reproductive requirements. . Likely? Perhaps not, but these are activists committed to ensuring that not one woman in this country gets an abortion and their actions over the last forty years have certainly shown that the ends justify all means. …preventing the disbursement of all or a portion of Federal financial assistance to a State or local government, or to a specific offending agency or program of a State or local government To say that would be chilling would be an understatement. Sub-zero would be more like it. What state government could stand on a woman’s right to an abortion with Medicaid or at a hospital if ALL federal funds could be stopped? What hospital would keep training doctors if all federal funds from Medicaid to Medicare would be withheld? Funding has become the dangerous back door that will de facto overturn Roe v. Wade HR #3 ENFORCEMENT SECTIONS: SEC. 311. NO GOVERNMENT DISCRIMINATION AGAINST CERTAIN HEALTH CARE ENTITIES. `(a) Nondiscrimination- A Federal agency or program, and any State or local government that receives Federal financial assistance (either directly or indirectly), may not subject any individual or institutional health care entity to discrimination on the basis that the health care entity does not provide, pay for, provide coverage of, or refer for abortions. `(b) Health Care Entity Defined- For purposes of this section, the term `health care entity’ includes an individual physician or other health care professional, a hospital, a provider-sponsored organization, a health maintenance organization, a health insurance plan, or any other kind of health care facility, organization, or plan. ` (c) Remedies- `(1) IN GENERAL- The courts of the United States shall have jurisdiction to prevent and redress actual or threatened violations of this section by issuing any form of legal or equitable relief, including– ` (A) injunctions prohibiting conduct that violates this section; and `(B) orders preventing the disbursement of all or a portion of Federal financial assistance to a State or local government, or to a specific offending agency or program of a State or local government, until such time as the conduct prohibited by this section has ceased. `(2) COMMENCEMENT OF ACTION- An action under this subsection may be instituted by– `(A) any health care entity that has standing to complain of an actual or threatened violation of this section; or `(B) the Attorney General of the United States.
