I’m sure this confusion over the role of the judiciary wouldn’t have anything to do with Mike Huckabee’s presidential aspirations! In a recent interview with right-wing radio host Steve Deace, former Arkansas Gov. Mike Huckabee claimed that lawmakers may flout court decisions they happen to disagree with : A president has certainly got to respect a ruling of the court, but if the ruling of a court is wrong, and it’s fundamentally wrong, and you have two branches of the government that determine that it’s wrong, then those other two branches supersede the one . . . . The two branches of government, legislative and executive, have every right to make it clear to the Supreme Court that their interpretation is wrong. And whether they do that by constitutional amendment to spell it out to the court, or by passage of further amplification of law, there are many means, I think, at hand to do that. Huckabee is, of course, wrong about the separation of powers — and embarassingly so. While Congress does have the authority to overrule court decisions that wrongly interpret its own acts , the whole point of having a Constitution is that it draws lines that can’t be crossed by elected officials. What’s the point of announcing that “ Congress shall make no law respecting an establishment of religion ” if Congress can ignore any court decision preventing it from establishing a religion?

When Ireland made the decision to protect all of its banks from losses and cover those losses by imposing austerity measures in 2008, Paul Krugman made hash of the conservatives’ argument for adopting that policy. As it turns out, he was right . Ireland relented on Sunday and formally applied for a rescue package worth tens of billions of dollars, after months of trying to survive its financial crisis with austerity measures and strict budgetary planning. European Union officials, who had been pushing Ireland to accept help, quickly agreed to the request, committing a staggering amount of funds to an ailing member for the second time in six months. Ireland’s fiscal crisis, like ours, has a mortgage meltdown as its root cause. However, the decision to impose severe austerity measures, including a big tax hike on Irish workers while insisting that the corporate tax rate remain one of the lowest in the world has not proven itself to be effective . An Irish bailout would mean humiliation for the government ahead of possible national elections early next year. Ireland would lose some control over its finances in return for loans, which could mean being forced to give up the country’s rock-bottom corporate tax rate – a key attraction to businesses that annoys other EU countries that have much higher rates. Because of the concern over panic and contagion, Ireland will request the bailout, and receive it. They should also raise those corporate tax rates sooner rather than later. Enough is enough. It’s proven time and again that low corporate tax rates will not sustain economic growth. Ireland’s austerity failure stands as a solid argument against conservative austerity nonsense here, there, and elsewhere .

Barnes and Noble Nook firmware version 1.5 now available

Barnes and Noble’s just made version 1.5 of its Nook e-reader’s firmware available. What can Nook owners expect from this latest upgrade? Well, the company says it boasts improved page refresh rates about 50 percent faster than the previous version — which is good news as we found it to be slower than its competitors . The update — which is available for both the 3G and WiFi versions — is also Barnes and Noble’s largest to date for the readers, and includes other fixes such as syncing across devices like the Nook’s various apps (finally!), customizable folders for your library, password protection options, improved search functions and battery performance.
