He opened up his program with the same barrage against conservatives that he launched in Time on Friday, namely that today's conservatism is woefully divorced from reality like the Marxists of the 19th century. Justice Clarence Thomas Should Resign For His Egregious Conflicts of Interest and Unethical Behavior

enlarge Has this country become so corrupt that our elected officials and the media will simply look the other way while Clarence Thomas makes a mockery of judicial impartiality? How nice that he has rich friends who do such nice favors — I’m sure it doesn’t influence him in the least: Justice Clarence Thomas is an ethics problem in a black robe. Just eight months after ThinkProgress broke the story of Thomas’ attendance at a Koch-sponsored political fundraiser , we learn that Thomas doesn’t just do unethical favors for wealthy right-wing donors — they also do expensive favors for him . Leading conservative donor Harlan Crow, whose company often litigates in federal court, donated $500,000 to allow Thomas’s wife to start a Tea Party group and he once gave Thomas a $19,000 Bible that belonged to Frederick Douglass. The American Enterprise Institute, a conservative think tank which frequently files briefs in Thomas’ Court, also gave Thomas a $15,000 gift.If this sounds familiar, it’s because America has seen this movie before. Indeed, the Thomas scandal is little more than a remake of the forty year-old gifting scandal that brought down Justice Abe Fortas. Like Thomas, Fortas liked to associate with wealthy individuals with potential business before his Court. And like Thomas, Fortas took inappropriate gifts from his wealthy benefactors. It is difficult to distinguish Fortas’ scandal from Thomas’. Like Fortas, Thomas accepted several very valuable gifts from parties who are frequently interested in the outcome of federal court cases. One of Thomas’ benefactors has even filed briefs in his Court since giving Thomas a $15,000 gift, and Thomas has not recused himself from each of these cases. Of course, Thomas is also the least likely Justice to actually follow the command of precedent. Thomas embraces a discredited theory of the Constitution which would return America to a time when federal child labor laws were considered unconstitutional . His fellow justices criticize him for showing “ utter disregard for our precedent and Congress’ intent.” Even ultra-conservative Justice Antonin Scalia finds Thomas’ approach to the law too extreme — in Scalia’s words “I am a textualist. I am an originalist. I am not a nut.” But Thomas’ disregard for what has come before him changes nothing about the precedent he faces. If Abe Fortas had to resign his seat, so too should Clarence Thomas.

Rep. Marcy Kaptur (D-OH) is what we used to call a “social justice Catholic,” just like Michael Moore. I can live with her stance against abortion because she fights like hell for every other interest of women, children and working people everywhere. She’s one of the most articulate, principled political figures we have. In this video from last week, she’s railing against the inadequate funding ($7 billion less than requested) in the Department of Agriculture funding bill and the effects it will have on the food stamp program and supplemental food programs like WIC. She was furious because the previous speaker on the House floor talked about Ayn Rand’s beloved “rugged individualism.” “Rugged individualism produces a heartless bill like this,” Kaptur retorted. She said if you wanted to know why the nation’s “in the dumpster”, go back to the 1990s. She calls Alan greenspan a “great proponent of rugged individualism” and tags Goldman Sachs and Morgan Stanley as “an interesting group of individuals that took America to the cleaners.” The spending bill “takes food away from about 350,000 women and children,” she said. She also challenged House members: “Most of the people here are Christian,” she said. “The first Beatitude says ‘Feed the hungry,’ not ‘rugged individualism.’ ” She bemoaned the “heartlessness” of those who take everything for themselves and turn their backs on the rest of the American people. In a warning to House Republicans, Kaptur said, “They didn’t clean house last November because they thought you were better. They just wanted a change and they’ll vote for it again if their lives don’t get better.” “This is the most gutless institution. Let them pay their fair share of taxes. We couldn’t even do that… They hurt the Republic. They hurt our country, and they have not been held accountable. …”I don’t have enough power to hold them accountable, but I hope God does. Because what they’ve done is unforgivable. Their rugged individualism is unpatriotic, it’s unChristian and it hurts this country.” “There has been no justice to this date. “I can guarantee you, for all the big shots who have cleaned up at the expense of the American people, most of them have never been to a WIC site and sat with mom…So I think the sad fact of this bill is, rather than big oil paying their fair share of taxes, then rather than us taking those bonuses from those who truly don’t deserve them because of what they did to the republic, for all the tax breaks that going to companies that are locating jobs overseas and taking our livelihood, the answer isn’t to take food away from those people that are paying the price. ” “… There are many people who talk about life – without decent nuttition, the hundreds of thousands of children in this bill, their brains won’t grow as fast.”

Alyssa Campanella, Miss California, Crowned 2011 Miss USA (PHOTOS)

Text by OSKAR GARCIA, Associated Press LAS VEGAS — America’s latest Miss USA winner is a California model and self-described history geek, obsessed with Britain’s monarchy of centuries past but also a fan of “Star Wars.” Alyssa Campanella of Los Angeles says on Twitter that she was born in the wrong time period and played the popular pig-exploding game Angry Bird backstage on her iPad before the pageant Sunday night. She hopes to keep modeling after her run as Miss USA is finished, depending on how she does representing the country at Miss Universe in September in Brazil. The celebrity she’d most like to meet, now that she’s one herself? Pastry chef Buddy Valastro of TLC reality show Cake Boss. “I love to bake cakes, and he’s an Italian, and he acts like I do in the kitchen,” the 21-year-old said after beating 50 other hopefuls in Miss USA’s 60th pageant at the Planet Hollywood Resort & Casino on the Las Vegas Strip. “Right now, I’m still kind of like – whoa,” Campanella said. WATCH: Miss California USA on WhoSay She strutted across the stage in a blue bikini with white polka dots, then donned a dark turquoise Sherri Hill evening gown with beading on its top. After making the final four, she answered a question about legalizing marijuana by saying she didn’t think it should be fully legalized as a solution to help ailing economies. She also professed a love for history after E! News anchor Giuliana Rancic asked her about it during the pageant. “I’m obsessed with the Stuart and Tudor era,” Campanella said. “Whenever I go to Barnes & Noble I’m always in the history section and that is where you will find me.” “I watch `Game of Thrones,’ I watched `Camelot’ – I know those are fantasy but I also watch the Tudors, so I’m a huge history geek,” she said. She said she grew up watching “Star Wars.” Campanella said during a news conference after the pageant that the win validated her decision to quickly move to Los Angeles from New Jersey after losing an apartment more than a year ago. “The downs happen for a reason,” she said. “The path that I’m on now is the path that’s been meant to be.” Campanella, a former Miss Teen USA runner-up from 2007, when she represented New Jersey, said she has been competing in pageants since she was 15 because of her mom. “I was going through a tough time in high school and she thought it’d be a great way for me to meet other girls throughout the state,” she said. “It’s Mom’s fault.” Originally from Manalapan, N.J., Campanella began modeling at age 16, graduated from high school a year early and received a scholarship to the New York Conservatory for Dramatic Arts, according to her personal website. Campanella said she thought the marijuana question posed to her from “Real Housewives of New Jersey” housewife Caroline Manzo was fair, given that she represents California. “Well, I understand why that question would be asked, especially with today’s economy, but I also understand that medical marijuana is very important to help those who need it medically,” she said during the pageant. “I’m not sure if it should be legalized, if it would really affect, with the drug war,” she said. “I mean, it’s abused today, unfortunately, so that’s the only reason why I would kind of be a little bit against it, but medically it’s OK.” Marijuana has been legal for medical use in California for about 15 years. Miss Tennessee Ashley Durham was the first runner-up, while contestants from Alabama and Texas placed third and fourth. Campanella, a natural blonde, said she dyed her hair six years ago for a part in a play, for a “fiery” character with whom she found she had traits in common. “It’s really brought out the true Alyssa Campanella, I feel, and that’s why I really enjoy being a redhead,” she said. Campanella replaces Miss USA 2010 Rima Fakih. The 25-year-old from Michigan teared up as she walked across the stage for a final goodbye. The pageant had three competitions: swimsuit, evening gown and interview question. The contestants were whittled to 16 after the show’s opening number, in which the beauty queens introduced themselves one-by-one. The top 16 were picked by preliminary judges through competitions and interviews during the week before the telecast. Celebrity judges picked the top eight after the swimsuit competition and the top four after the evening gown portion. Durham appeared to stumble as she answered a question from celebrity chef Rocco DiSpirito about whether the First Amendment should protect burning religious books, as it protects burning the flag. “I know that some people view it as a freedom of speech, however, burning the American flag is not patriotic at all,” Durham said. “No American citizen should do that, and you should also respect other religions. I’m a Christian and a faithful person. I would personally not appreciate someone burning the Bible, and that’s just a line you do not cross.” Miss Kentucky Kia Ben-et Hampton won Miss Congeniality USA, while Miss Arizona Brittany Dawn Brannon won Miss Photogenic USA. The Miss Universe pageant is scheduled for Sept. 12 from Sao Paolo, Brazil. Last year’s winner was Mexico’s Jimena Navarrete.

Looking for Jobs in All the Wrong Places

Here’s one for the White House suggestion box: President Obama — Be careful about where you seek job creation advice. This week marked the second meeting of the President’s Council on Jobs and Competitiveness, a 26-person panel of business and labor leaders appointed by President Obama to generate a national strategy for job creation. Whether or not the Jobs Council can truly help fix America’s job crisis, it’s too soon to know, but there’s ample reason to be skeptical. “Good for Obama’s jobs council, good for America?” was the question posed by The Washington Post, which went on to note that five of the companies with executives on the Council — General Electric, Citigroup, Intel, Procter & Gamble and DuPont — generate the bulk of their revenues overseas. And the GOP blasted the President for his choice of venue — a manufacturer of energy-efficient lighting in Durham, NC, called Cree, Inc. President Obama praised Cree for “putting people back to work in a field that has the potential to create an untold number of new jobs and new businesses right here in America.” But the Republican National Committee issued a release saying that Cree — which received a $39 million tax credit in stimulus funds — has more than half of its 5,000-person workforce in China. The GOP also points to industry press reports that during the grand opening celebration of the company’s first Chinese plant in December, the CEO promised more expansion in China and said, “Cree management never runs this company as a U.S. company.” These are not the only signs that the interests of the President’s Council are not necessarily shared by America’s workforce. Consider, for instance, the high-tech job training plan announced by President Obama with great fanfare on Monday. “Today, with the leadership of the Jobs Council, we’re announcing an all-hands-on-deck strategy to train 10,000 new American engineers every year.” The reason, he explained: Right now, there are more than four job-seekers for every job opening in America. But when it comes to science and high-tech fields, the opposite is true. The businesses represented here tell me they’re having a hard time finding high-skilled workers to fill their job openings. And that’s because today only 14 percent of all undergraduate students enroll in what we call the STEM subjects — science, technology, engineering, and math. That may be true, but recent research shows the number of STEM students graduating each year from U.S. universities far exceeds the number of new jobs. And while U.S. corporations decry the shortage of tech talent — industry data indicates there are upwards of 200,000 tech workers unemployed across the country today. Even with this glut of job-seekers, companies say the talent shortage is SO acute that they are forced to import foreign labor from overseas. Over the past year, Dan Rather Reports has done a series of programs about the foreign labor force brought here by a vast array of U.S companies ostensibly to do jobs they can’t find Americans to fill. Using an alphabet soup of special temporary work visas, employers have imported millions of foreign workers — from hotel housekeepers to farm laborers to software engineers. It’s part of the federal guest worker system and it’s perfectly legal. Most people — including guest workers — might assume that if a U.S. company decides to sponsor a person to come here on work visa, they must have tried to hire an American first. But that’s not the necessarily the case. According to U.S. Department of Labor, a guest worker visa known as H-1B for “specialty occupations” especially tech workers — may be issued “even when a qualified U.S. worker wants the job.” In fact, the bulletin notes, “A U.S. worker can be displaced from the job in favor of the foreign worker.” Guest workers have little leverage to complain about wages or working conditions because unlike citizens or legal permanent residents, they are dependent on their employers not just for their paycheck, but also for their immigration status. If they lose their job, they may lose their right to be in the country. Despite laws requiring H-1B employers to pay guest workers what’s known as a “prevailing wage,” the cost savings offered by visa-holders are an open secret in the tech world. (See, for example, this report in last week’s Washington Post.) The federal government doesn’t have any official counts of the guest worker population. Estimates put the current number of H-1B visa holders alone somewhere between 600,000 and 1,000,000. In recent years, U.S. corporations have been using an ever-proliferating array of temporary visas to import foreign labor –including visitor visas, which as we reported in a recent Dan Rather Reports, are not supposed to be used for any purpose involving gainful employment. In Washington, business leaders and lawmakers have been pushing to ease visa rules and caps. And across the country, high-tech workers — both foreign and domestic — are seeing the notion of job security give way to a brutal contest of survival. Getting displaced, undercut and swapped out by fresher, better, cheaper talent has simply become the reality of today’s job market. Dan Rather Reports took a close look at the trickle-down effects in this week’s program, “No Thanks for Everything.” It was four personal stories from four tech workers, in their own words. Even after years watching U.S. companies moving more and more “jobs of the future” overseas, these workers never imagined that they might be displaced by foreign workers in their own hometowns. Now in the name of American competitiveness, the President’s Jobs Council is not only calling for high-tech job training, but also for visa reforms — reforms that would not close loophole or staunch misuse, but increase the flow of foreign arrivals. It’s no wonder that so many people once living the American dream are feeling shell-shocked — sucker-punched by a job market that their own government has rigged against them. And consider this. Cree, the North Carolina company that the President chose as the backdrop for his job initiative, has filed dozens of H-1B applications for foreign workers in recent years, according to U.S. Dept. of Labor records.
