Yesterday, Judge George Caram Steeh, a federal judge in Michigan, ruled that ObamaCare’s requirement that all individuals purchase health insurance is justified under the Constitution’s Commerce Clause . The decision ( pdf ) is worth reading, but here’s the key passage: Far from “inactivity,” by choosing to forgo insurance plaintiffs are making an economic decision to try to pay for health care services later, out of pocket, rather than now through the purchase of insurance, collectively shifting billions of dollars, $43 billion in 2008, onto other market participants. So while the Commerce Clause had previously been expanded to include all economic activity that affects interstate commerce, it has now, under this ruling, been further expanded to encompass all economic decisions that may, at some point in the future, have some effect on such commerce.  Peter Suderman , Allahpundit , and  Ilya Somin all have posts worth reading on the topic. Nokia N8 teardown reveals easily replaceable battery, ‘beefy’ construction

Surprise, surprise. The iFixit team have cornered themselves a dark grey Nokia N8 and have proceeded to do the one thing that comes naturally to them: disassembled it. It’s mostly good news all around with this teardown, which found the BL-4D battery cell was only two Torx screws away from being user-replaceable, while the overall N8 construction was praised as being the “beefiest” of any phone this year. There are plenty of bodacious highlights within, including the massive Xenon flash and the pair of camera modules — which are regrettably not removable from the main board. The touchscreen controller in the N8 is the same as has previously been used on the Kin Two and BlackBerry Torch . Perhaps that’s not the best pedigree in the world, but the (complete in one case, and relative in the other) lack of success of those phones was never really about the screen’s responsiveness. Funny how often Democrats can a ct like misogynists : In a private conversation that was inadvertently taped by a voicemail machine, an associate of Democratic gubernatorial candidate Jerry Brown can be heard referring to his Republican opponent Meg Whitman as a “whore” for cutting a deal protecting law enforcement pensions as the two candidates competed for police endorsements. The comment came after Brown called the Los Angeles Police Protective League in early September to ask for its endorsement. He left a voicemail message for Scott Rate, a union official. Brown apparently believed he had hung up the phone, but the connection remained intact and the voice mail machine captured an ensuing conversation between Brown and his aides. With evident frustration, Brown discussed the pressure he was under to refuse to reduce public safety pensions or lose law enforcement endorsements to Whitman. Months earlier, Whitman had agreed to exempt public safety officials from key parts of her pension reform plan. “Do we want to put an ad out? … That I have been warned if I crack down on pensions, I will be – that they’ll go to Whitman, and that’s where they’ll go because they know Whitman will give ‘em, will cut them a deal, but I won’t,” Brown said. At that point, what appears to be a second voice interjects: “What about saying she’s a whore?” “Well, I’m going to use that,” Brown responds. “It proves you’ve cut a secret deal to protect the pensions.” You mean like the deal Barack Obama gave the auto workers and the teacher’s unions? Is he a “whore” too?

Gamma Dynamics high-contrast, high-speed electrofluidic e-paper gets closer to reality

E Ink more or less has a lock on the e-reader market, as competitor after competitor sees delays or simply disappears altogether. Today we have an update from another would-be foe, and there’s some real potential here. It’s electrofluidic e-paper from Gamma Dynamics and the University of Cincinnati, which we first heard about last April . The tech is similar to that in E Ink but, instead of simple microcapsules having both black and white ink plus a clear oil, the Gamma Dynamics pixels have a colored fluid in a pixel that’s split by a reflective sheet. Using voltage applied to these pixels the ink can be forced up above or pulled down below the reflective separator, forming an image in a video-capable 20ms and delivering a near paper-matching 70 percent reflectivity. There’s a picture below showing how the tech works and, thanks to confirmation that it can be produced in an LCD manufacturing facility, it’s looking closer to production than ever. Krauthammer Slams Incompetence, Unseriousness of ‘The Colbert Democrats’

Columnist Charles Krauthammer scoured congressional Democrats on Friday in The Washington Post for failing to pass any appropriations bills or even introduce a bill extending any of the Bush tax cuts. The title was “The Colbert Democrats.” He concluded that: As if this display of unseriousness — no budget, no appropriations bills, no tax bill — were not enough, some genius on a House Judiciary subcommittee invites parodist Stephen Colbert to testify as an expert witness on immigration. He then pulls off a nervy mockery of the whole proceedings — my favorite was his request to have his colonoscopy inserted in the Congressional Record — while the chairwoman sits there clueless. A fitting end for the 111th Congress. But not quite. Colbert will return to the scene of the crime on Oct. 30 as the leader of one of two mock rallies on the Mall. Comedian Jon Stewart leads the other. At a time of near-10 percent unemployment, a difficult and draining war abroad, and widespread disgust with government overreach and incompetence, they will light up the TV screens as the hip face of the new liberalism — just three days before the election. I suspect the electorate will declare itself not amused. All this Colbert activism is welcome, in that it becomes quite clear that Colbert is just as much a sneering liberal as Jon Stewart — this march really makes them like running mates, or mocking mates. They are not just aiming for giggles. Just like liberal reporters, they’re aiming to make the country more liberal (“a better place”). But Krauthammer was not alone in scowling at the Colbert congressional testimony in the Post. Liberal columnist Ruth Marcus took a turn last week: But Colbert’s testimony was not history repeating itself as farce — it was history starting as farce. That’s to be expected when lawmakers appear, at their own risk, on “The Colbert Report.” But there is a difference between lawmakers electing to be a prop in Colbert’s show and letting Colbert turn their show into his prop. And that’s what happened before the House Judiciary Committee’s immigration subcommittee…. Granted, this isn’t the most embarrassing spectacle to unfold before Congress. (I was at the Anita Hill hearings, so I know firsthand.) Nor is it the biggest story around. But it is emblematic of the dumbing down of American political culture — more circuses, less bread. Colbert and Jon Stewart have more than enough material to lampoon politicians without Congress inviting them over for more. As usual, Stewart said it best, during his show Monday night. “Of course Colbert is more embarrassed than the House of Representatives,” he said. “Colbert still has dignity and integrity left to lose.”

HTC Mondrian render teases AT&T U-verse Mobile for Windows Phone 7, looks fatter than last time

Not that the connection between AT&T and HTC’s Mondrian WP7 handset was under much doubt anymore , but here’s the first image purporting to show the carrier-branded version of the device. The render is provided by 911sniper , whose long and distinguished record of leaking legit HTC ROMs leads us to believe it is indeed the real deal. It’s curious then to juxtapose the somewhat bulky Mondrian on show here against the press imagery recently unearthed by BestBoyZ — are we still looking at the same device? Our eyeball geometry would suggest not. Anyway, there’s not too long left to go until Microsoft tidies this alphabet soup of codenames up for us, and until then we suggest just enjoying that tantalizing tile titled AT&T U-verse Mobile . Cowon X7 debuts in home market of Korea with 4.3-inch screen, American ambitions

What was merely an indistinct outline in August is today a bona fide retail product. Cowon has made its X7 PMP official over in South Korea, letting us take a gander at the spec sheet if not necessarily buy one just yet. A 4.3-inch touchscreen takes center stage, backed by up to 160GB of hard drive storage and a battery rated to last for 103 hours of music or 10 hours of video playback. An FM radio tuner, built-in speaker, and Bluetooth chip fill out the “retro modern” body, while the software front reveals DivX-encoded video compatibility and a smattering of your usual note-taking and utility apps. The standard 160GB model is going on sale for 339,000 KRW ($304), or if you’re a globetrotter and need a set of preinstalled dictionaries, it’ll set you back 379,000 KRW ($340). There’s no word on US availability just yet, but this thing didn’t go through the chore of getting certified with the FCC for nothing.
